Jon Swenson is an intellectual property litigator with more than 20 years of experience representing technology companies in high-stakes disputes and complex business matters. His practice focuses on patent, copyright, trade secret, and commercial litigation, as well as strategic counseling for companies operating at the intersection of law and advanced technology.
Jon has led matters across the full lifecycle of litigation, from pre-suit investigations through trial, and is known for developing practical, business-oriented strategies that align legal outcomes with broader company objectives. His work frequently involves technically sophisticated subject matter and multi-jurisdictional considerations.
He has also represented clients in post-grant proceedings before the U.S. Patent and Trademark Office, achieving a 100% success rate in inter partes review (IPR) matters on behalf of both patent owners and challengers before the Patent Trial and Appeal Board.
In addition to litigation, Jon advises clients on transactions, acquisitions, intellectual property strategy, and risk management. Clients rely on him as a trusted advisor, seeking his guidance on a wide range of strategic and business-critical issues.
Prior to joining Cadwell Thomas, Jon was a partner in the Palo Alto office of Baker Botts for more than a decade before moving to Bend, Oregon to represent select technology clients as a solo practitioner.

Representative matters include:
- Secured a landmark victory for eBay in a United States Supreme Court case against MercExchange establishing that injunctions are not presumed in patent litigation
- Successfully asserted patent, trade secret, and related claims for a private AI software company against a multinational competitor, resulting in sanctions, findings of spoliation, and bankruptcy proceedings that strengthened the client’s market position
- Obtained a jury verdict of patent infringement involving AI-based expert systems on behalf of a Fortune Global 10 company against a direct competitor
- Achieved complete dismissal on the pleadings for a small company facing patent infringement claims by an international competitor
- Defeated claims against a technology client in a seminal open-source software dispute
- Represented leading communications technology companies in more than 50 patent matters with multi-billion dollars in dispute
- Secured recovery of hundreds of millions of dollars for an inventor in litigation involving modern computer processor architecture
- Won dismissal on the pleadings for a networking technology company, resulting in a full walk-away by the plaintiff
